The Sacramento County Office of Education provides services and tools for worldwide use of online lessons for adult learners, the creation and management of classes composed of adult learners, and the maintenance of records of class and individual learner performance on the website usalearns.org (the Site). By accessing and using usalearns.org, you grant your consent to the collection, use, and disclosure of information as described below. Note that our Privacy Policy may change in the future. Access and use of the Site in the future also constitutes consent to collect, use, and disclose information as described below or based on any additional or other terms added or substituted in the future. We encourage you to check back periodically to review the current Privacy Policy.

Who gets the information collected?

The Sacramento County Office of Education (SCOE) respects the privacy of Site users, and does not sell, rent, or otherwise provide personal information to third parties. Unless specifically stated otherwise, any information provided by you or otherwise collected is used only by usalearns.org as described below. However, there may be links on the Site that go to websites owned and/or operated by third parties who may have different privacy policies. You, and not The Sacramento County Office of Education, are responsible for knowing and understanding the privacy policies of third party websites before providing them with personal information.

Be aware that any personal information you might disclose, including performance records of Learners or Students, in the process of using the courses, units, lessons, and activities provided on the Site should be considered public information even though some of this information is accessible only with proper sign-in identification. The Sacramento County Office of Education encourages you to be cautious about incorporating personal information in lessons and activities available on the Site.

What kind of information is collected?

The Sacramento County Office of Education collects two kinds of information from Site users: individual information and aggregated information.

Individual information includes personal information such as your name, sign-in name and email address. We use this information to establish an individual account, which enables teachers to create, organize, and maintain their classes and records. This information also allows us to contact you to alert you to Site features and services or to respond to your inquiries.

Aggregated information includes any information that cannot be related to an individual. In order to better understand the needs and preferences of Site visitors and evaluate the usefulness and popularity of Site features and services, we may from time to time collect information such as the number of times certain pages or features are accessed, the type of browsers used to access the Site, or the website users visited previously or visited next.

How is information collected?

Information is gathered in several ways. Before teachers can create and maintain a class, they must complete a registration form. This form requires a sign-in name, password, first and last name, and email information in order to teach English online. This information makes it possible for teachers to create and organize their classes and records and for us to respond to inquiries or announce new Site tools or features.

Whenever you access the Web on the Internet, an IP address is automatically assigned to your computer. This address allows Web servers to identify your computer. The IP address does not provide any personal information about the computer user. The IP address is used for system administration, to gather aggregated information on the Site use, and to help you and your Records remain properly connected during and between visits.

While you are visiting the Site, cookies may be sent from the Site’s server to your computer. Cookies are small files used to help maintain continuity during and between visits and help keep track of your activities, lessons, classes, and records on the Site. Cookies can also help determine the most popular pages and features of the Site. Like an IP address, a cookie identifies a computer, not you or any personal information. You may be able to configure your Internet browser to refuse cookies or to ask you whether to allow cookies. If you have cookies disabled, refuse, or do not allow cookies to be used during a visit to the Site, you may not be able to use many of the tools and features of the Site.

If you contact the Site through its help or support feature, we may keep that correspondence on file so that we can better respond to comments, questions, or concerns. In order to respond to you directly, an email address or other contact information is needed.

Are there any circumstances in which The Sacramento County Office of Education would disclose information to third parties?

Under normal circumstances, the Sacramento County Office of Education does not disclose information to third parties. Exceptional circumstances could include:

  1. Protecting the integrity and security of the USA Learns site,
  2. Precautions against liability,
  3. Protection of the safety, rights, or property of users or others,
  4. Response to requirements of the judicial process or, to the extent permitted by law, requests of law enforcement or public safety agencies.

Even in these circumstances, account information is only released if USA Learns believes it to be reasonably necessary.

What security measures are used to protect my personal information?

Access to Site content and personal information is protected by firewalls, sign-in names, passwords, and Secure Socket Layer (SSL) encryption. In spite of these security measures, we strongly recommend that users not send, copy, or link to the Site any confidential personal or financial information such as bank account, credit card, or social security numbers. While we exercise reasonable care to preserve your privacy and the security of your personal information, no transmission of information over the Internet can be guaranteed to be totally secure.

Therefore, we cannot warrant the security of any information transmitted to the Site. Any and all information that is transmitted to USA Learns through the Internet will be at your (the user’s) own risk. We encourage you to exercise discretion in deciding what type of information you include in Registration, Records, and all Writing or Typing Activities that you include on the Site.

European Union General Data Protection Regulation (GDPR) – Privacy and Data Removal

Do you want your user account and data removed from the USA Learns website? Just email us (help@usalearns.org) and we will completely remove your USA Learns account and data for you.

As mentioned on this page, we do not share your data with anyone. Once your account is removed, your name, email address, activity scores, and related data will be completely deleted as a part of removing your account.

USA Learns Acceptable Use Policy

This Acceptable Use Policy (AUP) sets out the terms between all individuals of the USA Learns site and the Sacramento County Office of Education under which individuals may access the website usalearns.org (the Site). This acceptable use policy applies to all managers, developers, users, and visitors (individuals) to, the Site.

An individual’s use of the Site means that they accept and agree to abide by all the policies contained within this AUP as well as the Terms of Service of the Site.

PROHIBITED USES

USA Learns is aware that there are those who would use the Site in an unlawful or inappropriate manner. All individuals may use the Site only for lawful and appropriate purposes. Individuals may not use the USA Learns site:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm any person in any way.
  • To send, knowingly receive, upload, download, use or reuse any of the Site content or material for profit
  • To send, upload, download, use or reuse any of the Site content or material for misuse.
  • To transmit or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam) without the express approval, knowledge and written permission of a representative of the Site.
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware while using the Site.

Individuals Agree:

  • Not to reproduce, duplicate, copy or resell any part of the Site. To do so would be in violation of the provisions of the Site Terms of Use.
  • Not to access without authority, interfere with, damage or disrupt:
    • any part of the Site;
    • any equipment or network on which the Site is stored;
    • any software used in the provision of the Site; or
    • any equipment or network or software owned or used by any third party.

SITE COMMUNICATIONS

Communications that occur within, outside of, or related to the Site, include but not limited to:

  • Electronic mail (email),
  • Email with any kind of file attachment
  • Recordings within Site activities
  • Writing or typing within Site activities (Communications).

Communications will be allowed as follows:

  • Individuals must comply with the applicable law in any country from which Communications are posted.

Communications must not:

  • Contain any material which is defamatory of any person.
  • Contain any material which is obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right or trade mark of any other person, business or entity.
  • Be likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Be threatening, abuse or invade privacy, or cause annoyance, inconvenience or needless stress or anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person, business or entity.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person, business or entity.
  • Give the impression that they emanate from the Site, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

INTERACTIVE SERVICES

USA Learns may provide interactive services on the Site, including, but not limited to:

  • Chat capability
  • Messaging systems
  • Uploading or downloading of different file formats (interactive services).

USA Learns and its representatives will do their best to assess any possible risks for individuals from third parties when they use any interactive service provided on the Site. USA Learns and the Sacramento County Office Education will take all possible and realistic precautions to ensure the safety and well-being of individuals of the Site. However, USA Learns nor the Sacramento County Office of Education are under any obligation to oversee, monitor or moderate any interactive service provided on the Site. USA Learns and the Sacramento County Office of Education expressly exclude their liability for any loss or damage arising from the use of any interactive service by an individual of the Site.

MINORS

Although the Site is intended for adults to learn English online in a free online setting, there is no exclusion or age requirement for the Site. Those individuals under the age of 18 (a Minor) may also register on the Site for the purpose of learning English. The use of the Site by a Minor should be subject to the consent of their parent or guardian and it is the sole responsibility of the parent or guardian whether to allow a Minor’s use of the Site. USA Learns strongly advises parents and guardians who permit a Minor to use ANY site that they communicate with the Minor the importance of safety online. Minors who are using ANY site should be made aware of the potential risks to their person and well-being.

Parents and guardians should be aware that USA Learns nor the Sacramento County Office of Education are under absolutely no legal or moral obligation to oversee, monitor or moderate any interaction or communication that a minor may have on the Site with any individual. USA Learns and the Sacramento County Office of Education expressly exclude and absolve themselves from all responsibility from a Minor’s use of the Site.

SUSPENSION AND TERMINATION

USA Learns and the Sacramento County Office of Education will determine, in their discretion, whether there has been a breach of this AUP through the individual’s use of the Site. When a breach of this policy has occurred, action may be taken as deemed appropriate.

Failure to comply with this AUP constitutes a material breach of the Terms of Site use upon which you are permitted to use the Site, and may result in the taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of the individual’s right to use the Site
  • Immediate, temporary or permanent removal of any posting, interaction or communication by the individual to the Site
  • Issue of a warning to the individual
  • Legal proceedings against the individual for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach
  • Further legal action against the individual as deemed appropriate by the Sacramento County Office of Education
  • Disclosure of such information to law enforcement authorities as USA Learns and the Sacramento County Office of Education reasonably feel is necessary

USA Learns and the Sacramento County Office of Education exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and other any other action deemed appropriate may be utilized and implemented.

CHANGES TO THE ACCEPTABLE USE POLICY

The USA Learns Acceptable Use Policy may be changed or amended at any time. It is the sole responsibility of the Individual to check the Site AUP to take notice of any changes that are made as they are legally binding upon the Individual. Some of the provisions contained within this AUP may be superseded by provisions or notices published elsewhere on the Site and are the responsibility of the Individual to be aware.
